These Terms and Conditions govern your access to and use of the Melique Sound website and the online music production and audio services offered through it. By browsing this website, requesting a quote, or engaging Melique Sound for any service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the website or the services.

01Who we are and what these terms cover

Melique Sound ("Melique Sound", "we", "us", or "our") is an online music production and audio studio that provides custom music creation, audio editing, mixing, mastering, sound design, custom instrumentals, podcast editing, and full music production. All services are delivered digitally to artists, content creators, and businesses.

These Terms apply to the website, to any quote or proposal we issue, and to every project we accept, together with any policy referenced within them. Where a signed proposal, statement of work, or project agreement contains terms that differ from these Terms, the project-specific document will prevail for that project.

02Eligibility and accounts

You must be at least eighteen (18) years old, or the age of legal majority in your jurisdiction, to engage our services. If you are acting on behalf of a company or another person, you represent that you have authority to bind that party to these Terms.

You are responsible for keeping any credentials, project links, and delivery folders we share with you secure, and for all activity that occurs through them.

03Services and quotations

Descriptions of services and price ranges shown on the website are indicative and provided for general guidance. The scope, deliverables, revision allowance, timeline, and final price for any engagement are confirmed in a written quote or proposal before work begins.

A quotation is valid for the period stated within it and may be revised if your requirements change, if the source material provided differs materially from what was described, or if additional work is requested beyond the agreed scope.

04Placing an order and acceptance

A binding engagement is formed only when we confirm your project in writing and, where applicable, the agreed deposit or payment has been received. Submitting a request through the website or by email is an invitation for us to quote and does not by itself create a contract.

We reserve the right to decline any request at our discretion, including where the requested work is unlawful, infringes third-party rights, or falls outside the services we offer.

05Your responsibilities

Timely, high-quality collaboration is essential to audio work delivered online. You agree to:

  • provide accurate briefs, references, session files, stems, and any assets required, in the formats we request;
  • ensure you hold all necessary rights to the material you supply to us;
  • respond to requests for feedback, approvals, and information within the timeframes we agree; and
  • review deliverables promptly and raise revision requests within the agreed window.

Delays caused by missing materials, incomplete briefs, or slow feedback may extend timelines and are not the responsibility of Melique Sound.

06Fees, payment, and taxes

Fees are set out in your quote and are payable in accordance with our Payment Policy. Unless stated otherwise, prices are quoted in United States dollars and are exclusive of any taxes, duties, or transaction fees that may apply, which are your responsibility.

We may require a deposit before commencing work and full payment before final files are released. Late or failed payments may result in suspension of work and withholding of deliverables.

07Revisions and delivery

Each engagement includes a defined number of revision rounds, described in your proposal and in our Project Delivery and Revision Policy. Additional revisions, changes of direction, or new requirements are chargeable at our then-current rates.

Delivery methods, formats, and estimated timelines are confirmed per project. Estimated timelines are good-faith projections and are not guarantees.

08Intellectual property and licensing

Ownership of, and licenses to, the music, audio, and other deliverables we create are governed by our Intellectual Property and Music Licensing Policy. In general, rights transfer or license to you only upon full payment, and Melique Sound retains ownership of its own tools, techniques, presets, templates, and pre-existing materials.

Content you provide to us remains yours and is handled in accordance with our Client Content and Copyright Policy.

09Cancellations and refunds

Cancellations and any refunds are handled under our Refund and Cancellation Policy. Because production work is bespoke and begins soon after acceptance, amounts covering work already performed are generally non-refundable.

10Acceptable use of the website

You agree not to misuse the website, including by attempting to gain unauthorized access, introducing malicious code, scraping content at scale, or using it in any way that is unlawful, infringing, or harmful. We may suspend or restrict access to protect the website, our services, or other users.

11Disclaimers

The website and its content are provided on an "as is" and "as available" basis. While we take care to keep information accurate and current, we do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

Creative outcomes are inherently subjective. We commit to professional standards and to the agreed scope, but we do not guarantee any particular commercial result, chart performance, streaming outcome, or audience response.

12Limitation of liability

To the fullest extent permitted by law, Melique Sound will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or relating to the website or the services.

Our total aggregate liability for any claim relating to a given engagement will not exceed the total fees actually paid by you to Melique Sound for that engagement.

13Indemnity

You agree to indemnify and hold harmless Melique Sound from claims, damages, and reasonable costs arising from material you supply to us, from your use of the deliverables, or from your breach of these Terms, to the extent such claims are attributable to you.

14Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict-of-law principles. The parties will first attempt to resolve any dispute informally and in good faith before pursuing other remedies. Where litigation is necessary, it will be brought in the courts located in the Commonwealth of Kentucky.

15Changes to these terms

We may update these Terms from time to time. The version in force is the one published on this page, identified by the "Last updated" date above. Continued use of the website or our services after changes are posted constitutes acceptance of the revised Terms.

16Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Together with the policies referenced here and any project-specific proposal, these Terms form the entire agreement between you and Melique Sound regarding their subject matter.
